Privacy Policy

Introduction

OffshorePH is committed to protecting the personal information that clients, job applicants, contractors and website visitors share with us. This Privacy Policy explains what we collect, why we collect it, who we share it with and the choices you have.

It applies to information we collect offline and online, including through www.offshoreph.com, the OffshorePH System and our associated social media pages (together, the “Site”). In this policy, “OffshorePH”, “we”, “us” and “our” refer to OffshorePH and its related entities.

By using the Site or giving us your personal information, you agree to its collection, use and disclosure as described here. If you do not agree, please do not use the Site or provide your information.

We usually collect this information directly from you, for example when you fill in a form, book a demo, apply for a role or contact us. We may also receive it from third parties such as recruitment platforms, job boards, referees, background-check providers, our clients and publicly available sources.

How We Use Personal Information

We collect, hold, use and disclose personal information to:

  • give you access to the Site, the OffshorePH System and our social media pages;
  • respond to enquiries, book demos and communicate with you;
  • recruit, shortlist and present candidates to clients, and assess employment or contractor applications;

  • invoice clients, process payments and pay contractors;
  • keep internal records and run our business;
  • analyse Site use, conduct market research and improve our services;
  • send you news, offers and marketing about our services, and about third parties we think may interest you;
  • run referral programs, promotions or competitions; and
  • comply with our legal obligations, prevent fraud and resolve disputes.

We will only use your information for another purpose if it is related to one of the above and you would reasonably expect it, or if you consent or the law allows it.

Cookies and Web Beacons

Our Site uses cookies, which are small text files your browser stores to remember your settings and how you use the Site. Cookies on their own do not reveal your name or email address. If you later give us personal information, it may be linked to data held in a cookie.

We use tools such as Google Tag Manager and Google Analytics to measure traffic and performance. Advertising partners such as Google, Meta and LinkedIn may also use cookies to show you our ads on other websites and social media (retargeting).

We may also use web beacons, also called pixel tags or clear GIFs. These are tiny pieces of code that tell us when a page or email has been viewed, or help place a cookie.

You can block or delete cookies in your browser settings, or manage them through our cookie consent banner where available. Some parts of the Site may not work properly if you do.

We do not sell your personal information. We may share it with:

  • Service providers who help us run our business, such as IT, cloud storage, web hosting, payroll, payment processing, background checks, marketing, analytics and professional advisers;
  • Our employees, contractors and related entities, including affiliated companies in Australia, the United States, Singapore, the United Kingdom and the Philippines;
  • Business partners and agents, including referral partners and sponsors of promotions we run;
  • A buyer or successor, if all or part of our business or assets is sold, merged or transferred;
  • Credit reporting and debt collection agencies, if an account is not paid; and
  • Courts, regulators and law enforcement, where required by law, in legal proceedings, or to establish, exercise or defend our legal rights.

International transfers

OffshorePH is based in the Philippines and serves clients worldwide. Your information may be stored or processed in the Philippines, Australia, the United States, Singapore, the United Kingdom and other countries where our service providers or we operate.

When we transfer information overseas, we take reasonable steps, such as contracts and security standards, to ensure it is protected in line with this policy and applicable law. By providing your information, you consent to these transfers.

Sensitive Personal Information

Some information receives extra protection under privacy laws. This includes details about your race or ethnic origin, health, religious or political beliefs, sexual orientation, criminal record, biometrics, and government-issued identifiers such as tax, SSS, PhilHealth or Pag-IBIG numbers.

We only collect sensitive personal information when it is reasonably needed for our services, such as pre-employment checks or statutory payroll contributions, and only with your consent or where the law permits. We use it solely for the purpose it was collected and apply stricter access controls to it.

Storage, Security and Retention

We use reasonable physical, technical and organisational safeguards to protect your information from misuse, loss and unauthorised access, change or disclosure. These include access controls, secure servers, encryption where appropriate and staff confidentiality obligations.

No internet transmission or storage system is completely secure, so we cannot guarantee the security of information sent to us online. You send information at your own risk.

We keep personal information only as long as needed for the purposes in this policy, or as required by law, tax or accounting rules. When it is no longer needed, we securely delete, destroy or anonymise it.

If a data breach is likely to cause you serious harm, we will notify you and the relevant regulator as required by law.

Your Rights and Choices

We handle personal information in line with the Philippine Data Privacy Act of 2012 (Republic Act No. 10173) and, where they apply, other laws such as the Australian Privacy Act 1988, the UK GDPR and EU GDPR, and US state privacy laws. Depending on where you live, you have the following rights:

  • Consent: Giving us personal information is voluntary. If you choose not to, we may be unable to provide some services or consider your application. You may withdraw consent at any time, although this will not affect processing already carried out.
  • Information from third parties: If we receive your information from someone else, we will protect it under this policy. If you give us information about another person, you confirm you have their permission to do so.
  • Access: You may ask for a copy of the personal information we hold about you. We may charge a reasonable fee where the law permits, and may refuse a request in limited cases allowed by law.
  • Correction: If your information is inaccurate, incomplete or out of date, tell us and we will take reasonable steps to correct it.
  • Objection and restriction: You may object to, or ask us to limit, how we use your information, including for direct marketing.
  • Erasure: You may ask us to delete or block your information when it is no longer needed or was processed unlawfully.
  • Data portability: You may ask for your information in a commonly used electronic format.
  • Unsubscribe: You can opt out of marketing emails at any time using the unsubscribe link in each message or by contacting us.
  • Complaints: If you believe we have mishandled your information, contact us with full details. We will investigate and reply in writing within a reasonable time. If you are not satisfied, you may complain to the National Privacy Commission of the Philippines or the privacy regulator in your country, such as the Office of the Australian Information Commissioner.
